Conditions of Travel + Cancellation Policy

Please read and understand the conditions of booking set out in this section prior to booking a trip with Adventure Tours.

We strongly recommend that you also read the more detailed online version of your itinerary prior to booking to ensure that you understand the itinerary and style of the trip you are undertaking.

ITINERARIES

Itineraries are correct at the time of publishing and may differ slightly to those featured in the brochure. Occasionally our itineraries change as we make improvements based on comments from past travellers and our own research or there are changes in the offerings from operators we use. If we are unable to utilise a product, service or activity detailed in our itinerary, a suitable alternative will be offered where possible.Itineraries may vary and/or attractions be substituted for any cause including seasonal conditions, weather extremes, natural disasters, Traditional Owner and national park requirements. All activities in individual itineraries are included unless otherwise stated as own expense.

OPTIONAL ACTIVITIES

All optional activities listed must be paid direct to the operator and are subject to seasonal conditions, operator availability and time constraints and are not guaranteed.

PRICES

Pricing is valid for travel commencing 1st April 2012 until 31st March 2013. Rates are quoted in AUD inclusive of GST and are correct at time of publication. Prices can be subject to change at the discretion of ATAG Pty Ltd. No responsibility is accepted by ATAG Pty Ltd for unforseen omissions or misrepresentation of touring partners.

PAYMENT POLICY

A 25% deposit is required at the time of booking, with the remaining amount due no later than 30 days prior to departure. Failure to adhere to the payment policy may result in the cancellation of your booking. A non-refundable credit card surcharge of 1.5% applies on all Mastercard and Visa transactions (3% on Amex).Please note: Tour Partner payment policies vary from the above and are subject to change at any time. These are available on request from our Customer Service Team.

CANCELLATION POLICY

Due to the extensive organisation involved with touring, a strict cancellation fee will be applicable to compensate for costs and lost revenue. Once a booking is made the following cancellation fees will apply:

East Coast

  • 29 - 42 days 40% of Fare
  • 28 - 14 days 60% of Fare
  • 13 - 7 days 80% of Fare
  • 6 - 3 days 90% of Fare
  • 2 - 0 days 100% of Fare

All other product

  • 48 Hours - 30 Days 25% of Fare
  • 24 Hours - 48 Hours 50% of Fare
  • Within 24 Hours 100% of Fare

If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund can be made. The above cancellation fees are in addition to fees which may be levied by accommodation house properties, travel agents or third party tour and transport operator cancellation fees. Please note: Kangaroo Island airfare is non-refundable. It is necessary to reconfirm tours 48 hours prior to travel – failure to do so may result in the booking being cancelled and fees charged.Please note: Tour partner and accommodation provider cancellation fees may vary from the above and are subject to change at any time. These are available on request from our Customer Service Team.

CHANGES TO BOOKINGS

In the event of a booking alteration (such as a name change or date change), Adventure Tours Australia and our third party tour operators, reserve the right to charge a fee where applicable.

CONDITIONS OF TRAVEL

ATAG Pty Ltd reserves the right to alter the route or itinerary of any of its tours and arrange alternative carriers to those advertised if necessary. No refunds will be given in these circumstances or in the event of any delay, curtailment or alteration of a trip resulting from any cause including severe weather conditions or mechanical failure. Components of trips are weather dependant and ATAG Pty Ltd cannot be held liable if trip components are not available on the day of travel. ATAG Pty Ltd can not guarantee pick up or drop off times and is not liable for passenger failure to connect with other services or any associated costs resulting from such delays. We accept no responsibility for loss or damage to personal belongings or baggage.The Aboriginal components of our tours are subject to cultural conditions. Participants may be absent due to cultural commitments with minimal prior notification and ATAG Pty Ltd reserves the right to amend the itinerary in these circumstances with no obligation to refund. Where an Aboriginal guide is unavailable or passenger numbers are below 10 an Adventure Tours guide will lead the cultural experience.  . 

LIABILITY

Whilst we make every effort to safeguard our passengers, ATAG Pty Ltd cannot be held liable for any damage, injury, or loss of any kind caused by or resulting from any act or omission by its employees, agents or contractors. Passengers should note that adventure travel involves a higher than normal risk and a signed release will be required from all participants before departure. ATAG Pty Ltd also assumes no responsibility for any act of negligence, act or omission whatsoever by any company whose services are used as part of packages provided, including but not limited to activity and accommodation providers.

MINIMUM PASSENGER NUMBERS

Tours require a minimum number of passengers to operate. Minimum passenger numbers differ between tours and operators and are subject to change at any time. In circumstances where minimum numbers are not reached an alternative may be offered or a smaller vehicle used. If a tour is cancelled due to minimum passenger numbers not being reached, passengers will be offered an alternate tour option or be provided with a full refund.

DIESEL FUEL LEVY

ATAG Pty Ltd reserves the right to charge a fuel surcharge as a result of escalation in the price of crude oil.

TRAVEL INSURANCE

Travel insurance in NOT included in the tour price. Adventure Tours Australia Group Pty Ltd requires all passengers to hold travel insurance.Policy information must be provided on Day 1 of each tour. Your Insurance protection must include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance.Please note that during your trip there may be opportunities to take part in adventure activities or excursions, outside the itinerary as shown in the brochure.These do not form part of your contracted trip with Adventure Tours Australia and you should ensure your Travel Insurance covers your participation in these activities. Travel insurance is compulsory for all travellers except where prohibited by law. Australian nationals travelling in Australia are exempt from this policy although we do still highly recommend Travel Insurance.Travel insurance is available to purchase online at http://www.adventuretours.com.au/syndicate/worldnomads-com/travel-insurance

PICK UP AND DROP OFF POINTS

All pick up and drop off locations and times published are an estimate only and are subject to change at short notice. Passengers will be advised of correct details at the time of reconfirmation.RECONFIRMING TOURSIt is compulsory to reconfirm tours at least 48 hours in advance. CHILD POLICY*/AGE RESTRICTIONS

Children 7 years and under are not recommended to travel on any tour. Individual requests may be considered on a case by case basis by ATAG Pty Ltd.Children aged 8-12 years receive a discount on some tours, Children 13 years or older pay full adult fare;Children 12 years and under:

  • Are not permitted to travel on Kimberley Safaris and Kakadu Unleashed.
  • Are not recommended to travel on the 2 Day Red Centre Explorer, 2 day 4WD Kakadu Explorer or Western Australian touring other than the Pinnacles Day Tour. Requests however may be considered on a case by case basis.
  • Children under 14 years are not permitted to travel on day tours ex Melbourne.
  • Children under 18 years of age are not permitted to travel unless accompanied by an adult excluding ADL<>MEL<>SYD<>CNS and ADL<>ASP, where under 18's are not permitted to travel with or without an accompanying adult.
  • Our touring partner Topdeck recommends the above regions 18–39 years old. Requests however, may be considered on a case by case basis.
  • Tasmania tours offer both age recommended departures (18-39 years) and open age departures (7+ years) please refer to tour details or contact our Customer Service Team for further details.
  • Child prices for accommodated tours are based on one child sharing an ensuite room with two adults. If one child travels with one adult the adult rate for accommodation applies and will be provided upon request.
  • Requests for child travel and pricing should be directed to reservations@adventuretours.com.au.
  • The policies for children travelling on tour partner tours may vary from the above and are available on request.
  • Depending on age, children on tour may be required to be seated in booster seats or other child safety accredited seating. At all times, ATAG Pty Ltd reserves the right to not accept children on tours due to safety concerns.

FEES AND LEVIES

Fees and levies have been included in the total price and are payable at time of booking.

  • Uluru – Kata Tjuta National Park: AUD$25
  • Kakadu National Park: AUD$25
  • Twin Falls boat transfer (seasonal) AUD$12.50
  • Tasmanian National Parks: AUD$12 per entry
  • Credit card payments: 1.5 – 3% surcharge

Children aged 15 years and under will not be charged entry to Uluru – Kata Tjuta National Park, Kakadu National Park or Twin Falls boat transfer.

SLEEPING BAGS

Tours in the Northern Territory and between Darwin and Adelaide, and Exmouth and Darwin require sleeping bags. Sleeping bags may be hired for AUD$25 per person from ATAG Pty Ltd. In some circumstances sleeping bags maybe purchased for AUD$50 each.

FITNESS and PARTICIPATION

Our tours are active and most require a reasonable level of fitness. NOTE: Tours graded 'Advanced' and 'Advanced Plus' (or listed as three boots or more) on the fitness guide are only suitable for very fit and active people who enjoy basic bush camping. They are not suitable for children. If you have any doubts about the suitability of your clients please check with our Customer Service Team as we reserve the right to assess suitability to participate at check-in. With the exception of our 'Safari' tours, passengers are expected to help with the preparation of food, washing of dishes and general assistance as directed by the guides.

MEALS

Our emphasis is on fresh food wherever possible and our meals are nutritious and varied. We cater for vegetarian and gluten intolerance – please advise at time of booking.

LUGGAGE

Luggage must be kept to a MAXIMUM OF 15KGS (except KAKADU tours which are restricted to a MAXIMUM OF10KGS) in a backpack or soft overnight bag with a small day pack for easy access to camera, sun block etc. It is recommended to plan ahead and arrange to store bulky items at pre-tour accommodation. It may be necessary to freight excess luggage at passenger's expense.

SMOKING AND DRINKING

Australian Government regulations prohibit smoking and the drinking of alcohol inside all tourist vehicles in Australia (smoking and drinking should be limited to designated stops.

BEHAVIOUR

Adventure Tours is not a common carrier and therefore can refuse to carry a person whose behaviour is detrimental to the enjoyment of the group. By travelling with Adventure Tours, you agree to accept the authority of the guide and accept their decisions. Our staff are entitled to a safe working environment and our passengers to a great holiday. Any threats to safety, being physical or verbal, or inappropriate behaviour may result in removal from the trip. 1. Our Contract

All bookings are made with Intrepid Travel Pty Ltd, trading as Adventure Tours Australia (ABN 35 007 172 456) (us/we). By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

2. Validity

Dates, itineraries and prices are valid from 01 April 2013 until 31 March 2014.

3. Payment Policy

A 25% deposit is required to confirm a Day Tour or Short Break Tour (see details below under Clause 4) with the remainder due no later than 30 days prior to departure. A deposit of AU$250 is required on Extended Tours and Packages (see details under Clause 4) at time of booking with the remaining amount due no later than 56 days prior to departure. Failure to adhere to the payment policy may result in the cancellation of your booking. A non-refundable credit card surcharge of 1.5% applies on all MasterCard and Visa transactions (3% on Amex). Please note: Tour Partner payment policies vary from the above and are subject to change at any time. These are available on request from us.

4. Cancellation of Booking by Passenger

Due to the extensive time and planning involved with touring, a strict cancellation policy is applicable to compensate for costs and lost revenue. Once a booking is confirmed the following cancellation fees will apply:

» Day Tours and Short Break Adventures (tours of 5 days or less)

25% deposit confirms tour with full payment required 30 days before departure.

Cancellation Fees for Day Tours and Short Break Tours

  • 30+ days prior to departure; no fee payable
  • 16-29 days prior to departure; 25% of total price
  • 2-15 days prior to departure; 50% of total price
  • Within 24 hours of departure; 100% of total price

» Extended Tours and Packages (tours of 6 days or more)

A deposit of AU$250 confirms tour with full payment required 56 days before departure;

Cancellation Fees for Extended Tours and Packages

  • 56+ days prior to departure; we retain the deposit
  • 30–55 days prior to departure; 50% of total price
  • Within 29 days of departure; 100% of total price

East Coast, Tasmania and New Zealand (tours operated by our tour partner Topdeck)Including Cairns<>Sydney<>Melbourne<>Adelaide<>Alice Springs (Unleashed 18-39 tours).

  • 42+ days prior to departure; no fee payable
  • 29–41 days prior to departure; 40% of total price
  • 28–14 days prior to departure; 60% of total price
  • 13–7 days prior to departure; 80% of total price
  • 6–3 days prior to departure; 90% of total price
  • 2–0 days prior to departure; 100% of total price

5. Amendments to Bookings

» Amendment Fees Day Tours

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 15 days prior to the proposed departure date. A fee of AU$50 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 15 days prior to the proposed departure date our cancellation conditions apply.

» Amendment Fees Short Break Tours (tours of 5 days or less)

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 30 days prior to the proposed departure date. A fee of AU$100 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 30 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

» Amendment Fees Extended Tours and Packages (tours of 6 days or more)

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 56 days prior to the proposed departure date. A fee of AU$150 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 56 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

» Amendments Fees East Coast, Tasmania and New Zealand (tours operated by our tour partner Topdeck)

Including: Cairns<>Sydney<>Melbourne<>Adelaide<>Alice Springs (Unleashed 18-39 tours).If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 42 days prior to the proposed departure date. A fee of AU$100 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 42 days prior to the proposed departure date our cancellation conditions apply.

Other Change/Amendment Fees for all Tours

Amendments to any other arrangements made in conjunction with your trip will incur an AU$100 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 7 days of departure. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.

6. Cancellation by Adventure Tours

We may cancel a trip at any time up to 28 days before departure. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, Travel Insurance excess or non-refundable flights. Please note that different cancellation conditions may apply to some Day Tours and Short Break Adventures - please ask us.

7. Prices & Surcharges

Our trip prices are based on currency exchange rates published by OANDA in August 2012. We reserve the right to impose surcharges up to 28 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for the first 2% of the additional costs and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full.

8. Minimum Numbers & Combination Trips

Some of our tours require minimum numbers to guarantee their departure. If you would like to know how many people are booked on your trip or any combination trip it is part of please ask prior to making your booking. Many of our trips are designed to fit with other departures to create a longer "combination" trip; this means that some of your group may have already been travelling together for some weeks when you commence your trip.

9. Travel Insurance

Travel Insurance is compulsory for all Adventure Tours travellers and should be taken out at the time of booking. Your Travel Insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. You must provide proof of your Travel Insurance on the first day of your trip. However it is also recognised that in some countries (eg. Germany and Austria) local consumer laws do not permit the compulsory purchase of Travel Insurance. Clients from these exempt countries who choose to travel without holding an adequate and valid Travel Insurance policy will be asked to complete an Insurance Waiver form before commencement of their tour. Australians are not required to be covered for medical expenses on trips within Australia. However we strongly recommend that you have a domestic Travel Insurance policy which covers personal liability, cancellation, curtailment and loss of luggage and personal effects.

10. Age Requirements

For the majority of our trips the minimum age for children is 8. All travellers under the age of 18 must be accompanied by an adult who is responsible for the child's day to day care. Please note; families must upgrade from dorm-share accommodation to private rooms. On camping trips, accompanying adults may be required to share with others in the group on a twin share basis. Variations: a lower minimum age may apply on Short Break and Day Tours. Please be aware of our specially designed Unleashed 18-39 tours.

11. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

12. Authority on tour

Our group trips are run by a Tour Guide. The decision of the Tour Guide is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.

13. Acceptance of risk

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. It is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

14. Limitation of liability

We contract with a network of companies, government agencies and individuals to assist in the running of our trips as agents for these third parties. We are not responsible for the acts and omissions of these third parties.To the fullest extent of the law:

  • Liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded
  • You release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip.
  • Any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty) is excluded. To the extent Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value: or (ii) a refund of the total amount received by us from you in connection with your booking.
  • Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your Tour Guide or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

15. Claims & Complaints

If you have a complaint about your trip please inform your Tour Guide at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

16. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason than such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

17. Privacy Policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a Trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our Website).

18. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia.

If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees. Please note: Kangaroo Island airfare is non-refundable. It is necessary to reconfirm tours 48 hours prior to travel – failure to do so may result in the booking being cancelled and fees charged.

5. Amendments to Bookings

» Amendment Fees Day Tours

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 15 days prior to the proposed departure date. A fee of GB£30/EU€40 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 15 days prior to the proposed departure date our cancellation conditions apply.

» Amendment Fees Short Break Tours (tours of 5 days or less)

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 30 days prior to the proposed departure date. A fee of GB£65/EU€80 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 30 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

» Amendment Fees Extended Tours and Packages (tours of 6 days or more)

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 56 days prior to the proposed departure date. A fee of GB£100/EU€120 per person per change may apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 56 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

Other Change/Amendment Fees for all Tours

Amendments to any other arrangements made in conjunction with your trip will incur a GB£65/EU€80 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 7 days of departure. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.

6. Cancellation by Adventure Tours

We may cancel a trip at any time up to 28 days before departure. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, Travel Insurance excess or non-refundable flights. Please note that different cancellation conditions may apply to some Day Tours and Short Break Adventures - please ask us.

7. Prices & Surcharges

Our trip prices are based on currency exchange rates published by OANDA in August 2012. We reserve the right to impose surcharges up to 28 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for the first 2% of the additional costs and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full.

8. Minimum Numbers & Combination Trips

Some of our tours require minimum numbers to guarantee their departure. If you would like to know how many people are booked on your trip or any combination trip it is part of please ask prior to making your booking. Many of our trips are designed to fit with other departures to create a longer "combination" trip; this means that some of your group may have already been travelling together for some weeks when you commence your trip.

9. Travel Insurance

Travel Insurance is compulsory for all Adventure Tours travellers and should be taken out at the time of booking. Your Travel Insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. You must provide proof of your Travel Insurance on the first day of your trip. However it is also recognised that in some countries (eg. Germany and Austria) local consumer laws do not permit the compulsory purchase of Travel Insurance. Clients from these exempt countries who choose to travel without holding an adequate and valid Travel Insurance policy will be asked to complete an Insurance Waiver form before commencement of their tour. Australians are not required to be covered for medical expenses on trips within Australia. However we strongly recommend that you have a domestic Travel Insurance policy which covers personal liability, cancellation, curtailment and loss of luggage and personal effects.

10. Age Requirements

For the majority of our trips the minimum age for children is 8. All travellers under the age of 18 must be accompanied by an adult who is responsible for the child's day to day care. Please note; families must upgrade from dorm-share accommodation to private rooms. On camping trips, accompanying adults may be required to share with others in the group on a twin share basis. Variations: a lower minimum age may apply on Short Break and Day Tours. Please be aware of our specially designed Unleashed 18-39 tours.

11. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

12. Authority on tour

Our group trips are run by a Tour Guide. The decision of the Tour Guide is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.

13. Acceptance of risk

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. It is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

14. Limitation of liability

a. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause c. below.

b. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause c. below.

c. we shall not be liable for any damage or loss if the failure to carry out the contract is:• Attributable to you.

Attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.

  • Due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even with due care exercised.
  • Due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
  • Due to an event which the Company, even with all due care, could not foresee or forestall.

d. Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to 3 times the price paid. In the case of damaged property the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.

e. Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions.

f. our acceptance of liability in clauses a and b above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury.

g. Flight Notice, Flight Information and EU Blacklist.This is a notice required by European Community Regulation (EC) No.889/2002.This notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of the Regulation or the Montréal Convention, and it does not form part of the contract between the carrier(s), us and you, nor part of a claim. No representation is made by the carrier(s) or us as to the accuracy of the contents of this notice.

Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your Tour Guide or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

15. Claims & Complaints

If you have a complaint about your trip please inform your Tour Guide at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

16. Privacy Policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a Trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our Website).

17. Applicable law

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia.
